New Delhi, the 20th December 2023

  1. No. Sec/NCISM/Reg(1)/2023.In exercise of the powers conferred by sub-section (1) and clause (h) (i) (j)

(k) (l) (m) (n) (o) of sub-section (2) of section 55 of the National Commission for Indian System of Medicine Act, 2020 the commission hereby makes the following regulations, namely:-

  1. Short title and commencement. -(1) These regulations may be called the National Commission for Indian System of Medicine (National Examinations for Indian System of Medicine) Regulations, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

  1. Definitions.- (1) In these regulations, unless the context otherwise requires,-
    • “Act” means the National Commission for Indian System of Medicine, Act, 2020 (14 of 2020);
    • “Appendix” means an Appendix appended to these regulations;
    • “Commission” means the National Commission for Indian System of Medicine;
    • “Counseling authority”
      • in relation to central counselling committee means the authority to conduct counselling and seat allotment for all India quota seats
      • in relation to State or Union territory means the authority to conduct counselling and seat allotment for state or Union Territory quota seats
    • “designated authority” means any agency or authority authorised by the Commission or an examination cell established by the Commission, for planning, coordinating and conducting various national examinations as mentioned in these regulations or as specified by the commission from time to time.

(2) Words and expressions used herein and not defined in these regulations, but defined in the Act on the rules framed there under shall have the same meanings as respectively assigned to them their in.

  1. Examination cell.-(1) The examination cell shall be established by the Commission and it shall consist of one controller of examination and two deputy controller of examination, one for Board of Ayurveda and other for Board of Unani, Siddha and Sowa-Rigpa.
  • The examination cell shall conduct tests or examinations, specified under chapter IV of the Act or as may be decided by the Commission from time to time.
  • The examination cell shall verify the details of students admitted for undergraduate, postgraduate courses in the Indian System of Medicine submitted by the medical institutions in the following manner, namely: –
    • the medical institutions that have been permitted to admit the students for that academic session shall submit the data of information of the students admitted to undergraduate, postgraduate courses in the format specified in Appendix-I, II, III, IV and V appended to these regulations, within the stipulated date and time and mode of submission as specified by the Commission from time to time;
    • details of the candidates (undergraduate) submitted by the medical institutions as specified in clause (ii) of Sub-regulation (7) of regulation 5 of National Commission for Indian System of Medicine (Minimum Standards of Undergraduate Ayurveda Education) Regulations-2022, clause (ii) of Sub-regulation (7) of regulation 4 of National Commission for Indian System of Medicine (Minimum Standards of Undergraduate Unani Education) Regulations-2022 and clause (ii) of Sub-regulation (7) of regulation 4 of National Commission for Indian System of Medicine (Minimum Standards of Undergraduate Siddha Education) Regulations-2022, in the format provided in Appendix– I, shall be verified with the data of National Eligibility-cum-Entrance Test results provided by the designated authority;
    • the number of students admitted to any undergraduate course or postgraduate course, as the case may be, shall be within the number of seats permitted for that academic year by the Medical Assessment and Rating Board for Indian System of Medicine;
    • all students except eligible foreign national candidates, shall be admitted through counselling conducted by the counselling authority of the Central or State or Union territory as the case may be;
    • the details of the candidates to the undergraduate, submitted by the medical institutions in the format provided in Appendix-I, shall be verified with the data provided by the respective counseling authority (in the format provided in Appendix-II), entrance test conducting designated agency to ensure that all the students were admitted through respective counseling authority such as Central or State or Union territory counseling authority, as the case may be;
    • the details of the candidates postgraduate courses submitted by the medical institutions (in the format provided in Appendix-III) shall be verified with the data of All India AYUSH Postgraduate Entrance Test results provided by the designated authority;
    • the details of the candidates to the postgraduate courses submitted by the medical institutions (in the format provided in Appendix-III) shall be verified with the data provided by the concerned counseling authority (in the format provided in Appendix–IV);

 

  • the examination cell shall submit the data verification report (institution wise) along with the discrepancies if any, to the respective boards such as Board of Ayurveda and Board of Unani, Siddha and Sowa-Rigpa, as the case may be, for the direction to allotment the Unique Ayush identity document;
  • every admitted undergraduate student of Ayurveda, Siddha and Unani shall be allotted unique Ayush identity document as under:
    • the data of information of all the admitted students, submitted by the medical institutions as specified in clause (a) of sub-regulation (3) of regulation 3 shall be allotted temporary Ayush identity document within thirty days from the cut-off date of admissions to Ayurveda, Unani, Siddha and Sowa-Rigpa Undergraduate courses and such temporary identity document shall bear the year of admission followed by the respective stream for Ayurveda-AYU, Unani-UNI, Siddha-SID and Sowa-Rigpa- SRG and serial number of student,

for example-2021 AYU 25424;

  • The Board of Ayurveda or the Board of Unani, Siddha and Sowa-Rigpa, as the case may be, shall approve the verified data of admitted students submitted by the examination cell and direct the examination cell for allotment of unique Ayush identity document and the Unique Ayush identity document shall bear the year of admission followed by institution identity document, abbreviation of state or union territory and serial number of the student,

for Example- 2021 AYU0459 UK 17256;

  • in case of transfer of a student from one college to other college, the unique Ayush identity document shall be modified as under: –
    • letter ‘T’ denoting the ‘Transfer’ shall be inserted in the stream abbreviation that is AYT, UNT, SIT and SRT;
    • the institutional identity document and State or Union territory code shall be replaced with the new institutional identity document and State or Union territory code as applicable;

for example: in case a student having Ayush ID2021-AYU0459-UK 17256 transferred from Uttarakhand college (AYU0459) (UK) to Rajasthan College (AYU0232) (RJ),

the new Ayush identity document shall be 2021 AYT0232 RJ 17256;

  • in case of discrepancies or the details submitted by the colleges are in- correct, temporary Ayush identity document of such students shall be withdrawn and the matter shall be forwarded to Medical Assessment and Rating Board for Indian System of Medicine to proceed for disciplinary action as it deems fit.
  • if any the medical institution failed to submit the data as specified in clause (a) of sub regulation 3 of regulation 3, the examination cell shall recommends to the Medical Assessment and Rating Board for Indian System of Medicine, to impose penalty amount not exceeding one Lakh rupees per day or as specified by the Commission from time to time and such amount shall be made through National Electronic Funds Transfer or Real Time Gross Settlement into the National Commission fund for Indian System of Medicine;
  • The Controller of examinations shall have the following powers and functions, namely: –
    • To look into the affaires of examination cell;
    • to conduct examinations as specified in these regulations in consultation with Chairperson of the Commission and Presidents of concerned Boards of National Commission for Indian System of Medicine;
    • to prepare calendar of events of each examination and execute the activities as scheduled;
    • to identify of the suitable agency for conducting of various examinations and suggest to advisory committee for its approval;
    • to coordinate with the approved agency in conducting the assigned examination;
    • to share the data of eligible candidates to counselling authorities (central or state or Union territory) with the approval of the commission;
    • to assign the work to the deputy controller of examinations for the execution of the functions of the examination cell; and
    • any other activity as assigned by the Chairperson of the Commission and Presidents of the Board of Ayurveda and Board of Unani, Siddha and Sowa-Rigpa from time to time in this regard.

 

  • (a) The Commission may constitute sub-committees in accordance with the provisions of sub-section (3) of section 10 of the Act, for smooth functioning of the examination cell;
  • a common Advisory Committee for conducting the examination shall be constituted by the Commission in consultation with the respective Boards.
    • The Advisory Committee shall consist of–
      • Chairperson of National Commission for Indian System of Medicine – Chairperson;
      • President, Board of Ayurveda – Member;
      • President, Board of Unani, Siddha and Sowa-Rigpa – Member;
      • Nominee from Ministry of Ayush – Member;
      • Four Principals (one each from Ayurveda, Unani, Siddha and Sowa- Rigpa) – Member; and
      • Controller of Examinations – Member
    • Terms of reference: –
      • the term of the Advisory Committee shall be three years or re-constitution of the Committee by the Commission, whichever is earlier;
      • the Committee shall meet at least twice in a year;
      • the committee can co-opt any expert-member as per requirement and with the approval of the Chairperson;
      • the Committee shall approve suitable agency for conducting the examination or
  1. National Eligibility-Cum-Entrance Test for Ayurveda, Unani and Siddha. (1) National Eligibility-cum-Entrance Test for admission in undergraduate courses of Ayurveda, Siddha and Unani (ASU) shall be conducted in each academic year by the National Commission for Indian System of Medicine through the National Testing Agency or by any other agency designated by the Commission.
  • The eligibility criteria for appearing National Eligibility-cum-Entrance Test examination and admission in undergraduate courses of Ayurveda, Unani and Siddha shall be, as specified in regulation National Commission for Indian System of Medicine (Minimum Standards of Undergraduate Ayurveda Education) Regulations, 2022, the National Commission for Indian System of Medicine (Minimum Standards of Undergraduate Unani Education) Regulations, 2022 and the National Commission for Indian System of Medicine (Minimum Standards of Undergraduate Siddha Education) Regulations, 2022 respectively.
  • The process of counseling and admissions to undergraduate courses of Ayurveda, Unani and Siddha shall be as per the National Commission for Indian System of Medicine (Minimum Standards of Undergraduate Ayurveda Education) Regulations, 2022, the National Commission for Indian System of Medicine (Minimum Standards of Undergraduate Unani Education) Regulations, 2022 and the National Commission for Indian System of Medicine (Minimum Standards of Undergraduate Siddha Education) Regulations, 2022 and the guidelines issued by the Commission from time to time.
  1. National Eligibility-cum-Entrance Test to Sowa-Rigpa.- (1)The National Eligibility-cum-Entrance Test to undergraduate course of Sowa-Rigpa shall be conducted independently by the Commission every year through designated authority or agency or institute for the admission to the undergraduate course of Sowa-Rigpa in all Sowa- Rigpa institutions.
  • The examination shall be conducted offline or the mode as specified by the Commission from time to
  • The eligibility criteria for appearing National Eligibility-cum-Entrance Test for Sowa-Rigpa and admission to undergraduate courses of Sowa-Rigpa institution shall be as specified in the National Commission for Indian System of Medicine (Minimum Standards of Undergraduate Sowa-Rigpa Education) Regulations, 2022.
  • An All-India common merit list of the eligible candidates shall be prepared on the basis of the marks obtained in National Eligibility-cum- Entrance Test for Sowa-Rigpa and the qualified candidates shall be considered for admission to undergraduate course as specified in the National Commission for Indian System of Medicine (Minimum Standards of Undergraduate Sowa-Rigpa Education) Regulations, 2022 and such merit list shall be applicable for that particular academic session only.
  • The process of counselling and admissions in undergraduate courses of Sowa-Rigpa shall be as per the National Commission for Indian System of Medicine (Minimum Standards of Undergraduate Sowa-Rigpa Education) Regulations, 2022 and admission guidelines issued by the Commission from time to time.

 

  • The institution of Sowa-Rigpa shall submit the details of admitted students as per the Appendix-V or as may be specified by the Commission, on or before cut-off date for admission into Sowa-Rigpa institution for
  • (a) The Technical Committee for National Eligibility-cum-Entrance Test for Sowa-Rigpa shall consist of –
    • Controller of Examinations – Chairperson;
    • Nominee from designated agency as Director, National Eligibility-cum-Entrance Test for Sowa- Rigpa – Member;
    • Nominee from designated agency as Chief Co-ordinator, National Eligibility-cum-Entrance Test for Sowa-Rigpa – Member;
    • Member, Board of Unani, Siddha and Sowa-Rigpa – Member;
    • Member, Medical Assessment and Rating Board for Indian System of Medicine – Member;
    • Three Experts of Sowa-Rigpa system – Member; and
    • Deputy Controller of Examinations – Member Secretary

(b) Terms of reference:

  • the term of the committee shall be for two successive examinations or re-constitution of the committee by the Commission, whichever is earlier;
  • the Committee shall meet as required;
  • the Committee can co-opt any expert member as per the requirement and with the approval of the President, Board of Unani, Siddha and Sowa-Rigpa;
  • the Committee shall specify the syllabus and develop a ‘blue print’ of the question paper for every examination;
  • the committee shall prepare the schedule of entire examination events;
  • the committee shall prepare the list of chief superintendent of exam centres, National Commission for Indian System of Medicine observers, experts and moderators for question paper setting and evaluators for evaluating answer scripts;
  • the Committee shall coordinate with the assigned agency for conducting examination;
  • the committee shall prepare information brochure and examination-counselling-admission guidelines; and
  • the Committee shall ensure the confidentiality of the matters
